Loyalty Program’s Terms and conditions (the “Terms”)

 

Welcome to the Wojooh Beauty Rewards Program (the “Program”).

Within this document "you" or "your" means a valid member of the Program (the "Member") and any reference to "us", "our", or "we" means us, Wojooh, operated by the following companies, in the following countries (the “Country(ies) of Operation”):

1. MEMBERSHIP

The Program is only available to individual Members who have successfully completed the registration process.  You can register through:

  • Our website at the following address: wojooh.com (the “Website”)
  • Our Wojooh Beauty Rewards mobile app: (available on the Apple store, Android Market and/or Google Play platform-currently only in KSA).

 

To register you will need to provide:

  • A valid email address, which will be your Log in ID;
  • A local mobile phone number for the Country of Operation in which you are registering;
    • Your full name.

 

Your account is exclusively dedicated to you. You cannot assign, nor transfer your account to another person. You are entitled to register to one account only, the email address and mobile number provided at the registration being your unique identifier.

Only persons aged 18 years and above can participate in the Program.  

The Program is available in all Wojooh stores in the Countries of Operation as listed above.

Employees of the operating companies in each Country of Operation are not eligible to join the Program.

Members may only enroll to Wojooh Beauty Rewards in one Country of Operation.

 

2. COMMUNICATION

Your email address being your unique identifier, it will be used to communicate important information about your account, like your account balance and product information that may be of interest to you.

Accordingly, if any of your membership details change, please provide an account update via Wojooh Beauty Rewards online profile or through your mobile app profile.

However, if you do not wish to receive emails or SMS from us, you may inform us using the link at the bottom of any email or SMS you receive from us. You may also do so through your online account.

3. COLLECTION OF POINTS

Wojooh Beauty Rewards Points (the “Points”) will be issued to you when you purchase products in all participating Wojooh stores located in your Country of registration only, and/or when you purchase products online on the Website (for available countries only) for delivery in your Country of registration only, in accordance with Clause 4 (the “Transaction”). Points may only be collected in relation to your Transactions. You are not entitled to collect Points on Transactions entered into by any other person, such as family members, friends, acquaintances or business colleagues and on Transactions entered into in stores located outside of your Country  of registration. You are not entitled to claim or collect Points on Transactions completed prior to the date you have registered to join the Program.

In Wojooh stores located in your Country of registration: to earn your Points, you must present your registered mobile phone to the sales staff prior to starting your billing Transaction.

On the Website (for available countries only) and for delivery within your Country of registration (if available): to earn your Points, you must log in using your registered email address to be able to shop online. The Website is available for members to shop online from specific countries only.  

We will endeavor to update your account within thirty-six (36) hours. If you have not received your Points within this timeframe, you can call the Service Centre, who will be happy to investigate.

We reserve the right to withdraw Points awarded if you decide to return the products to which such award relates or if the Transaction is cancelled for any reason and a refund of the purchase price has been given. Points will not be cancelled for exchanges made with an equivalent Points value, nor in circumstances where a credit note is issued for the same amount. Where products are exchanged for those of a lower Points value we reserve the right to cancel the difference in value in Points.

We reserve the right to exclude vouchers and gift certificates from earning Points.

4. AWARD OF POINTS

There is no minimum spend per Transaction in order to qualify for earning Point(s).

Points will be awarded at the below mentioned rates for purchases made in the participating stores and/or on the Website (specific countries only) in the Countries of Operation:

1 Point per 1 Bahraini Dinar spent

In Qatar

1 Point per 1 Qatari Riyal spent

1 Point per 1 UAE Dirham spent

In Kuwait

12 Points per 1 Kuwaiti Dinar spent

In Jordan

5 Points per 1 Jordanian Dinar spent

In Lebanon

2.5 Points per 1000 Lebanese Pound spent

In Morocco

1 Point per 2.5 Moroccan Dirham spent

In Egypt

1 Point per 5 Egyptian Pound spent

 

Points collected as detailed above are ‘standard' Points.

From time to time, we reserve the right to withdraw/add participating stores and/or the Website from/to the Program, exclude products, or introduce extra Points promotions. Any applicable special terms and conditions for extra Points promotions will be made available to you at the time of the promotion.

We may also from time to time vary the rate at which Points are awarded. This will not affect Points already awarded in respect of previous Transactions.

We strongly advise you to regularly check the content of these Terms.

Points will not be awarded for purchases made with an employee discount. This includes employees of and employees of the affiliated companies of operating companies listed under Section 1 of these Terms.

5. REDEEMING POINTS

Redemption will be available as per the following:

In KSA

at a minimum of 1000 Points, and thereafter in increments of 500 points

In Bahrain

at a minimum of 100 Points, and thereafter in increments of 50 points

In Qatar

at a minimum of 1000 Points, and thereafter in increments of 500 points

In UAE

at a minimum of 1000 Points, and thereafter in increments of 500 points

In Kuwait

at a minimum of 1000 Points, and thereafter in increments of 500 points

In Jordan

at a minimum of 1000 Points, and thereafter in increments of 500 points

In Lebanon

at a minimum of 1000 Points, and thereafter in increments of 500 points

In Morocco

at a minimum of 1000 Points, and thereafter in increments of 500 points

In Egypt

at a minimum of 1000 Points, and thereafter in increments of 500 points

 

In participating stores located in your Country of registration, to redeem your Points, you will need to inform sales staff prior to starting your billing Transaction. They will then assist you through the process of validating your membership, recording the redemption amount and checking the Points availability. Upon completion of this process, a receipt will be printed and the relevant amount will be deducted from your bill.

On the Website (for available countries only) and for delivery within your Country of registration (if available), to redeem your Points, you will need to log in using your registered email address. The Website is available for customers to shop online from specific countries only.

Points cannot be exchanged for cash.

We will be continuously developing the Program in the Countries of Operation listed above to provide the best new and exciting redemption offers from our brands and introduce product or service offers via partnerships with other relevant companies. We reserve the right to add (or if necessary remove) rewards, or vary the number of Points required in exchange for rewards at our discretion, at any time.

 

6. POINTS EXPIRY

Your Points balance is valid for a period of two (2) years from the last day of the month in which they were earned. Your Points will be automatically deleted from your account upon expiry. Details of Points about to expire can be checked via the mobile app or via our website, and will be detailed on your monthly newsletter.

We strongly advise you to regularly check your Points balance.

 

7. ACCOUNT CLOSURE

You may close your account at any time by calling the Service Centre.

We reserve the right to close your account automatically if:

  • No Points have been collected or redeemed for a continuous period of two (2) years, or
  • You are found to have more than one Wojooh Beauty Rewards account registered in your name (in accordance with Clause 1 above), or
  • As result of our investigations we believe that there has been a breach of these Terms or special promotional terms. In such cases, we reserve the right, without limitation, to refuse to process a claim, refuse to award Points, to withdraw Points already awarded or to close your account. We also reserve the right to suspend your account while we carry on an investigation into potential misuse or fraud.

We will notify you in advance by email of the closing of your account.

8. DURATION

The Program will continue until terminated by us and we will endeavor to provide you with a three (3) months' prior written notice of such termination by email. Unredeemed Points will not be redeemable once the Program has been terminated.

 

9. PERSONAL DATA

By subscribing to the Program you expressly authorize Wojooh to collect your personal data (“Personal Data”) including without limitation:

  • Gender
  • Full Name
  • City of Residence
  • Date of Birth
  • Email address
  • Mobile phone number

Personal Data will be used by Wojooh, its employees, affiliated companies, employees of its affiliated companies, and its appointed third party contractors in order to enable Wojooh:

a) To keep track of your Transactions;

b) To allocate Points according to your Transactions;

c) To update you about Wojooh’s sales programs (eg. promotions, news, brand offerings etc.) through which you may earn Points;

d) To update Wojooh Beauty rewards’ profiling of your preferences so that Wojooh may tailor its products and services to serve you better.

Wojooh will endeavor to keep your Personal Data secured and confidential at all times.

Wojooh may delete your Personal Data in its database in the event that the Program is terminated for any reason whatsoever.

Wojooh does not guarantee and cannot be held liable for the accuracy of the information and data collected from you. Should you wish to amend or delete any of your data, you may do so, please refer to Section 2 of these Terms.

10. INDEMNIFICATION

You agree, at our request, to defend, indemnify, and hold harmless Wojooh and its affiliates, including their officers, directors, agents, suppliers and licensors from and against any and all claims, damages, costs, and expenses, including attorneys’ fees, arising from or related to your use of the Website, and subscription to the Program and any breach by you of these Terms or the use by any other person accessing the Website using your Internet account. Wojooh reserves the right, at our own expense, to assume the exclusive control of any matter otherwise subject to indemnification by you hereunder, and such right and indemnification will survive these Terms and your use of the Website and subscription to the Program.

 

11. LIMITATION OF LIABILITY

Nothing in these Terms is intended to affect your statutory rights as a consumer.

The use of the Website or any of the services or products and subscription to the Program available thereon is at your own risk, and unless otherwise stated in these Terms, you assume full responsibility and risk of loss resulting from your use of the Website or any of the services or products and subscription to the Program available thereon.

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL OR EQUITABLE THEORY, WHETHER IN TORT, CONTRACT, STRICT LIABILITY OR OTHERWISE, SHALL WOJOOH OR ANY OF ITS AFFILIATES, COMPANIES IN THE COUNTRIES OF OPERATION, EMPLOYEES, DIRECTORS, OFFICERS AND EMPLOYEES, DIRECTORS, OFFICERS OF ITS AFFILIATES AND COMPANIES IN THE COUNTRIES OF OPERATION, BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL LOSSES OR DAMAGES OF ANY NATURE ARISING OUT OF OR IN CONNECTION WITH THE PROGRAM, THE USE OF OR INABILITY TO USE THE WEBSITE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF GOODWILL, LOSS OF DATA, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, EVEN IF AN AUTHORIZED REPRESENTATIVE OF WOJOOH HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. SUBJECT TO THE FOREGOING, IN NO EVENT WILL WOJOOH BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE AMOUNT PAID BY YOU TOWARDS THE PRICE OF THE PRODUCT IN RESPECT TO WHICH THE CLAIM AROSE. YOU HEREBY RELEASE US FROM ANY AND ALL OBLIGATIONS, LIABILITES AND CLAIMS IN EXCESS OF THIS LIMITATION.

 

12. DISCLAIMER

OUR WEBSITE IS PROVIDED BY WOJOOH ON AN “AS IS” AND “AS AVAILABLE” BASIS. WOJOOH MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF OUR WEBSITE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON OUR WEBSITE. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, WOJOOH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, REASONABLE CARE AND SKILL OR NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WOJOOH DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, FOR ANY MERCHANDISE OFFERED ON OUR WEBSITE. YOU ACKNOWLEDGE, BY YOUR USE OF THE WEBSITE, THAT YOUR USE OF OUR WEBSITE IS AT YOUR SOLE RISK. THIS DISCLAIMER CONSTITUTES AN ESSENTIAL PART OF THESE TERMS.

 

13. MISCELLANEOUS

We reserve the right to modify these Terms at any time without notice to you. Any modifications of these Terms will be effective once published on our Website. Your continued use of the Website and/or the mobile application (or any of our other websites) following such change shall signify your agreement to be bound by the modified Terms. Please read the Terms and check back often. If you do not agree to any change to the Terms, then you must immediately stop using the Website and/or the mobile application.

These Terms constitute the whole legal agreement between you and Wojooh and govern your use of the Website and all services and products and the Program available thereon and completely replace any prior agreements between you and Wojooh in relation to the same.

You acknowledge and agree that the form and nature of the services may change from time to time without prior notice to you and Wojooh may stop providing the same (or any features within them) to you or to users.

You understand that Wojooh grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of creating publicly available searchable indices of the materials and Wojooh reserves the right to revoke these exceptions either generally or in specific cases.

You understand that you are solely responsible for (and that Wojooh has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which Wojooh may suffer) of any such breach.

If Wojooh does not exercise or enforce, or delays in its exercise or enforcement, of any legal right or remedy, this will not be taken to be a formal waiver of Wojooh’s rights.

You and Wojooh are independent contractors, and these Terms, including but not limited to submission or distribution of Your Personal Data and other content, will not, in whole or in part, establish any relationship of partnership, joint venture, employment, franchise or agency between the you and Wojooh. Neither party will have the power to bind the other or incur obligations on the other's behalf without the other's prior written consent. Neither party is authorized to act as an agent or representative of the other or for or on behalf of the other party in any capacity other than as expressly set out in the Terms. Neither party shall advertise, represent or hold itself (or any of its agents) out as so acting or being authorized so to act, or incur any liability or obligation on behalf of, or in the name of, the other party, unless specifically provided for in these Terms.

If any of the provision of these Terms is held to be illegal or unenforceable, the other terms of these Terms shall not be affected and shall remain in full force and effect.

These Terms are reproduced in English and Arabic. If there is any inconsistency between the English text and the Arabic text, the English text will apply.

These Terms shall be construed and governed by the laws of the relevant Country of Operation and the competent courts of the relevant Country of Operation where the Program operates shall have exclusive jurisdiction.
